Car breaks down after the car wash: is this a warranty case?

A man from Upper Austria bought an Alfa Romeo Tonale from a dealer for more than €30,000. After trips through the car wash, the ABS, ESC and power steering repeatedly failed. He lost at first instance before the Wels Regional Court – in essence because he could use other car washes instead. In the studio, Mag. Johannes Bügler, who is not involved in the case, assesses the legal position: what matters is what you can normally expect from a vehicle of this kind – and that includes being able to leave any car wash without safety-critical failures. More on statutory warranty when buying a car.

Motorway toilet injures doctor: €50,000 claim against Asfinag

The KURIER also reported on this unusual damages case. A GP from Meidling in Vienna was on her way back from a medical conference and stopped briefly at the Gönitz service area on the A2 to use the toilet. The heavy, self-closing metal door of the motorway toilet slammed shut and almost severed the tip of her right ring finger. Surgeons at Wolfsberg hospital had to reattach the fingertip. On behalf of his client, Mag. Johannes Bügler of Teamanwälte is claiming around €50,000 in damages for pain and suffering and loss of earnings from Asfinag, the motorway operator. As a doctor in private practice who sees around 50 patients a day, she has only been able to run her surgery on a limited basis since then. More on how damages for pain and suffering are assessed in Austria.

Fingertip severed at A2 rest area: doctor sues Asfinag for damages for pain and suffering

The Kleine Zeitung described the incident from a Carinthian perspective. At the Gönitz rest area on the A2 between Griffen and St. Andrä, the automatically closing toilet door struck the ring finger of a 63-year-old Viennese doctor so hard that the fingertip could only just be saved and was reattached in Wolfsberg. Mag. Johannes Bügler of Teamanwälte is claiming around €50,000 from Asfinag in damages for pain and suffering and loss of earnings. The motorway operator regrets the accident but sees no fault on its own part ‘at first glance’ and is examining the facts. There are around 100 toilet facilities of this design across Austria – the case shows when operators are liable for injuries caused by dangerous facilities. More on how damages for pain and suffering are assessed in Austria.

Motorway toilet door severs doctor’s fingertip: claim for damages for pain and suffering

The Kronen Zeitung reported on an unusual damages case. At the Gönitz rest area on the Southern Motorway (A2) near Wolfsberg, the heavy metal door of a motorway toilet slammed shut – it had no safety sensor, only a simple closing mechanism. It almost severed the top segment of a Viennese GP’s right ring finger, which had to be reattached at Wolfsberg hospital. Mag. Johannes Bügler of Teamanwälte represents the doctor. He is claiming around €50,000 in damages for pain and suffering and loss of earnings from the motorway operator, because she can now only run her surgery on a limited basis: ‘A closing mechanism as violent as this should not exist.’ According to Asfinag, there are around 100 toilets of this design in Austria – the case shows how operators can be liable for injuries caused by dangerous facilities. More on how damages for pain and suffering are assessed in Austria.

Bonus dispute at Wiener Linien: judgment for a ticket inspector

The Kronen Zeitung examined the ‘strange bounty system of Vienna’s public transport’ across a double-page spread. For six years, ticket inspectors received performance bonuses, including for penalising breaches of the house rules. In 2025, Wiener Linien, the city’s public transport operator, stopped these payments, citing an ‘oversight’. Mag. Johannes Bügler of Teamanwälte represented one of the inspectors affected, who – like many colleagues – lost hundreds of euros a month as a result. The Labour and Social Court ruled in his favour – the judgment is not yet final – and saw clear indications that this was more than a mere mistake. For us, the judgment is a possible precedent: around 150 other inspectors could claim back their reduced bonuses. Related practice area: Employment & social security law.

Termination after setting up a works council: paramedic prevails

A paramedic with the Sozialmedizinischer Dienst (SMD) wanted to set up a works council with colleagues and draw attention to grievances – shortly afterwards he lost his job. Two years after its first report, the Kronen Zeitung returned to the case, this time with a good outcome. Mag. Johannes Bügler of Teamanwälte represented the employee before the Labour and Social Court, where the proceedings ended in a settlement after lengthy negotiations. The paramedic received €15,000 – six months’ gross remuneration – and the employment relationship is treated as ended by mutual agreement. ‘We achieved a good result,’ said Bügler. His client has since completed nursing training and found new work in the healthcare sector. More on this: Challenging a termination.

Given notice after a long illness: city electrician represented by Teamanwälte

‘7 operations, 3 years off sick – now the city throws out electrician’, ran the Kronen Zeitung headline on the case of a long-serving employee of the City of Vienna (MA 33). A trained electrician who had worked for the city since 2007, he installed street lamps until constant overhead work ruined his shoulders. After seven operations and three years of sick leave, he was given notice instead of being offered other work. Mag. Johannes Bügler of Teamanwälte represents him before the labour court in Vienna: ‘Mr Reiter is willing to work. He just can’t hang lamps any more.’ MA 33 points to the alternatives it offered. At the heart of the case is the question of whether an employer must offer reasonable alternative employment before giving notice. More on this: Challenging a termination.

Defects on a North Cape tour: lawyer sees a claim for a refund

For a retired couple from Vienna, the coach tour ‘North Cape – to the Land of the Midnight Sun’ turned into a fiasco, as the Kronen Zeitung reported: the coach toilet was locked for many hours, sights were closed or reached only shortly before closing time, and the tour was abandoned in a snowstorm – ‘the worst holiday of our lives’, said the couple. They are claiming a refund of €2,934 from the tour operator plus €800 each in damages. The operator points to the early season, strict rules on emptying the toilet and proper winter tyres. Lawyer Mag. Johannes Bügler of Teamanwälte considers the claim reasonable: ‘The trip caused them serious disadvantages.’ The case is now before the court – a classic example of why it pays to have a lawyer check whether you are entitled to a price reduction and damages when a holiday has significant defects.

How Wiener Linien treats employees who are ill: lawyer voices criticism

‘Wiener Linien: former company doctor speaks out’, ran the Kronen Zeitung headline on a double-page spread about how the transport operator treats employees who are ill. Anyone who had been on sick leave for two months or longer had to see the company doctor with all their medical reports. There were said to be tight time limits for the assessments, which the company denies. After a former employee representative, the long-serving company doctor has now also spoken out; following his summary dismissal, he took Wiener Linien to court himself. Mag. Johannes Bügler of Teamanwälte represents him: ‘They obviously want people who don’t make waves, not people who look after others.’ The case touches on key questions – from the protection of sensitive health data to measures affecting employees’ pay. At a petrol station in Tyrol, a young woman was seriously injured in a deliberate attack with a vehicle, as the Kronen Zeitung reported. Mag. Johannes Bügler of Teamanwälte represents the victim’s family and is seeking appropriate redress. The key legal point: because the act was committed with a car, the motor vehicle liability insurer is liable for the damage – it can then bring a recourse claim against the offender. Fatal road accident in Lower Austria: family claims compensation for grief

The daily newspaper ‘Heute’ reported on a tragic case from Lower Austria. In August 2023, a 15-year-old girl driving a go-kart near Laa an der Thaya was hit by a car and died at the scene. Although the driver was found to have taken an overdose of a neuroleptic drug, the Korneuburg public prosecutor’s office discontinued the investigation – an expert report on the accident concluded that the impairment had not caused it. With our support, her parents and her sister are now claiming compensation for grief of €15,500 each through the civil courts. Mag. Johannes Bügler takes a critical view of the decision to drop the case: ‘There is clearly still a need for clarification here.’ The case shows that surviving relatives may have their own civil claims even after criminal proceedings have been discontinued. ‘Public transport doctor’ sues Wiener Linien: company doctor represented by Teamanwälte

‘“Public transport doctor” sues Wiener Linien’, reported the Kronen Zeitung. The doctor had worked for the transport operator since 2018, certifying bus, tram and underground drivers as fit for duty, until he was given notice in February 2024. He describes growing pressure to get through examinations ever faster – 30 minutes per new recruit, 60 minutes for long-serving drivers – and a ban on certificates of partial fitness. Wiener Linien firmly rejects this and cites incidents relevant to his employment. Mag. Johannes Bügler of Teamanwälte represents the doctor before the labour court in Vienna: ‘My client stood up for the health of the staff. Now that is being held against him.’ Related practice area: Employment & social security law.

Supreme Court confirms: music teacher’s dismissal was unlawful

In the employment dispute over the summary dismissal of a music school teacher in Himberg, the Supreme Court (OGH) confirmed what the Korneuburg Regional Court and the Higher Regional Court had already decided: the dismissal was unlawful because the staff committee had not been properly involved. The criminal proceedings previously brought against the teacher had already been discontinued, and part of his lost salary had been paid. Mag. Johannes Bügler of Teamanwälte represents the teacher, who is seeking reinstatement: ‘It has now been established at three levels of court that the bodies set up to protect the employment relationship were ignored when he was dismissed.’ The case underlines that a dismissal must also be formally correct if it is to stand. Declared ‘cancer-free’, dead months later: claim against the hospital

A 31-year-old Viennese woman had an aggressive form of breast cancer and took part in a drug trial in 2021, as the daily newspaper ‘Heute’ reported. After an operation in June 2022 she was considered ‘cancer-free’; according to the family, close follow-up checks had been presented as unnecessary. Around six months later, the young mother died. Mag. Johannes Bügler of Teamanwälte represents her mother and is claiming €17,000 in compensation for grief. The relatives say they had been persuaded that the trial was ‘the most effective treatment with the fewest side effects’. The hospital described the course of the illness as tragic but unavoidable. The case shows how demanding medical liability is where informing the patient, the choice of treatment and an illness’s unavoidable course come together. €50,000 after Tesla dispute: statutory warranty claim succeeds

A man from Burgenland had bought a Tesla Model X for around €128,940 a few years earlier – the daily newspaper ‘Heute’ reported on the legal dispute that followed. After numerous defects – rattling noises, vibrations, a weakening battery – and around 20 visits to the garage, Mag. Johannes Bügler of Teamanwälte filed a claim on his client’s behalf with the Vienna Commercial Court. Relying on statutory warranty law, he sought rescission of the purchase contract and a proportionate repayment. The manufacturer argued that the claim was time-barred – but the court still found in favour of the buyer: he is to get back around €50,000 (the judgment was not yet final at the time of the report).
